1. Acceptance of terms
By accessing or using Fever Muse (the "Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, Safety Policy, Cookie Policy, DMCA Policy, and Refund Policy (collectively, the "Agreement"). If you do not agree to all of these terms, you must not access or use the Service. We may update these Terms from time to time. If we make material changes, we will notify you by posting the revised Terms with a new effective date. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
2. Eligibility
The Service is for adults only. By accessing or using the Service, you represent and warrant that you are at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) and are legally permitted to view adult-oriented fictional companion content in your jurisdiction. You further represent that you are not prohibited from using the Service under any applicable law. If you do not meet these requirements, you must not access or use the Service. We reserve the right to verify your age and to restrict or terminate access if we have reason to believe you do not meet the eligibility requirements.
3. Nature of the service
Fever Muse is a web-based adult AI companion platform that provides AI-generated fictional conversations, scenario-based narratives, and media generation. All companion characters, conversations, and generated content are entirely fictional and AI-generated. The Service is not a game, therapeutic service, counseling platform, human matchmaking service, or substitute for emergency, legal, medical, or mental-health support. If you are experiencing a crisis, please contact appropriate emergency services in your jurisdiction. The AI companions are not sentient, do not have feelings, and cannot form real relationships.
4. Account registration and security
You may need to create an account to access certain features. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used in violation of these Terms.
5. Acceptable use
You may not use the Service to: generate, request, store, or distribute content that is illegal under applicable law; generate content depicting, describing, or involving minors in any sexual, exploitative, or abusive context; generate non-consensual sexual content or content that promotes real-world sexual violence; create content intended to harass, threaten, defame, or intimidate any real person; generate content that facilitates fraud, phishing, identity theft, or financial crimes; attempt to reverse-engineer, decompile, or extract the underlying models, algorithms, or source code of the Service; circumvent any technical measures, rate limits, safety filters, or access controls; use automated means (bots, scrapers, or similar) to access the Service without our written permission; resell, sublicense, or commercially redistribute any output of the Service; or impersonate Fever Muse, its staff, or any other person or entity. Violation of these restrictions may result in immediate account suspension or termination, content removal, and referral to law enforcement where appropriate.
6. Subscriptions, billing, and wallet
The Service offers free and paid subscription plans. Paid plans are billed on a monthly or annual basis as selected at the time of purchase. By subscribing to a paid plan, you authorize us to charge the applicable fees to your chosen payment method on a recurring basis until you cancel. Subscription fees are charged in advance for each billing period. Coin balances, video credits, and voice message quotas are governed by your plan tier and are enforced server-side. Monthly coin allotments and video credits reset at the start of each billing period and do not roll over to subsequent periods unless explicitly stated. Prices are subject to change. We will provide at least 30 days’ notice before any price increase takes effect for existing subscribers. For refund terms, see our Refund Policy.
7. Automatic renewal and cancellation
Paid subscriptions renew automatically at the end of each billing period at the then-current rate unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period — you will retain access to paid features until that period expires. No partial refunds are issued for unused portions of a billing period unless required by applicable law. Annual subscriptions that are cancelled mid-term will continue through the end of the prepaid annual period.
8. Intellectual property
The Service, including its design, code, models, branding, documentation, and all other proprietary materials, is owned by Fever Muse and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms. You retain ownership of the text prompts and inputs you submit to the Service. AI-generated outputs (including conversation text, images, and video) are provided to you under a personal, non-commercial license for your private use. You may not claim authorship of AI-generated outputs, use them to train competing AI systems, or redistribute them commercially without our prior written consent. We reserve the right to use aggregated, de-identified usage data for product improvement and research purposes.
9. User content and license grant
By submitting content to the Service (including prompts, messages, companion configurations, and feedback), you grant Fever Muse a worldwide, non-exclusive, royalty-free, sublicensable license to use, process, store, and display that content solely as necessary to provide, maintain, and improve the Service. This license continues for the duration of your account and for a reasonable period thereafter to allow for backup deletion and legal compliance. You represent and warrant that you have the right to submit any content you provide and that your content does not violate any third-party rights or applicable law.
10. Service availability and modifications
We strive to maintain high availability but do not guarantee that the Service will be uninterrupted, error-free, or available at all times. AI generation quality can vary due to model behavior, provider outages, rate limits, or infrastructure conditions. We may modify, suspend, or discontinue any feature or aspect of the Service at any time, with or without notice. We may update pricing, plan features, model routing, safety rules, generation capabilities, and platform behavior as the product evolves. We will use commercially reasonable efforts to provide advance notice of material changes that affect paid subscribers.
11. Account suspension and termination
We reserve the right to limit, suspend, or terminate your account and access to the Service at our sole discretion, with or without notice, for any reason, including but not limited to: violation of these Terms or any other policy; fraudulent, abusive, or illegal activity; conduct that threatens the security or integrity of the Service or other users; non-payment of fees; or extended inactivity. Upon termination, your right to use the Service ceases immediately. We may, but are not obligated to, retain or delete your data following termination, subject to our Privacy Policy and applicable law. You may terminate your account at any time through your account settings.
12. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FEVER MUSE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT OR OUTPUT WILL BE ACCURATE, RELIABLE, OR APPROPRIATE. AI-GENERATED CONTENT MAY CONTAIN ERRORS, INCONSISTENCIES, BIASES, OR HALLUCINATIONS. YOU USE THE SERVICE AND RELY ON ITS OUTPUTS AT YOUR OWN RISK.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FEVER MUSE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
14. Indemnification
You agree to indemnify, defend, and hold harmless Fever Muse, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: your use of the Service; your violation of these Terms or any applicable law; your content or any activity under your account; or your violation of any third-party rights. We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, at your expense.
15. Dispute resolution and arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") shall be resolved through binding individual arbitration administered by a recognized arbitration body under its then-current rules, rather than in court, except that either party may bring individual claims in small claims court if they qualify. The arbitration shall take place in the United States, and the arbitrator’s decision shall be final and binding. BY AGREEING TO THESE TERMS, YOU AND FEVER MUSE EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. You may opt out of this arbitration agreement by sending written notice within 30 days of first accepting these Terms. If any part of this arbitration clause is found unenforceable, the remainder shall continue to apply.
16. Governing law
These Terms and any Dispute shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. To the extent that arbitration does not apply, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware.
17. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The invalidity of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
18. Entire agreement
These Terms, together with the Privacy Policy, Safety Policy, Cookie Policy, DMCA Policy, and Refund Policy, constitute the entire agreement between you and Fever Muse regarding the Service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and Fever Muse regarding the Service.
19. Force majeure
Fever Muse shall not be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, riots, government actions, power failures, internet or telecommunications failures, AI provider outages, cyberattacks, or labor disputes.
20. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without your consent in connection with a merger, acquisition, corporate restructuring, or sale of all or substantially all of our assets. These Terms shall be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.
